Juvenile Sexual Assault
Sexual assault occurs when a person sexually involves themselves with another one without their permission, pressurization or by the use of physical force. There are various forms of sexual assault such as rape, forcible sodomy, and forcible object penetration. In some instances, it’s also facilitated by the use of drugs where one gets dizzy and loses their sense of judgment. It’s normally judged according to the degree of assault, first degree involves in the course of committing the assault the offender causes serious injuries to the victim. This is normally charged with life imprisonment with possibly no parole. The second degree involves the use of a weapon to threaten the victim, using force that can lead to death or when the victim is under 12years. This is punishable by 25yeras in prison with 70% of their time spent in prison before getting parole.
Third-degree involves committing the crime with force or when the victim has a relationship with the offender. The penalty involves 10years in prison and in case it was not forcible the court may grant probation. The juvenile system is set in place to deal with cases committed by people of a young age. It differs from the other court due to their sentencing means. A juvenile ranges from the age of 10 to 18, but in the case of a serious crime, one can be charged from the adult court. The sentencing for a juvenile can last up to a few hours of community service or years in a detention facility. They can also be registered as a sex offender but in the juvenile system, it’s up to 10years.

Generally, kids tend to disobey what they are told to do and do what they observe around them. Kids see and hear about sex from various platforms and this may arouse their curiosity. The two boys’ home environments may have played a greater role in their actions towards the girl. Due to the easy access to mobile phones, the use of the internet and even the camera if not well supervised may lead to them learning about this and enacting it. I suppose at home they have no close supervision from the parents hence they have no knowledge of what their kid is watching. The exposure to sexual images through television, popular songs, movies, and even video games, may result in confusion on the kids and aid in inappropriate behavior. Since kids learn more from what they see the peers in their surroundings may have played a greater part in influencing their behavior. They may have done it with an idea of curiosity, experiment or even just a bad judgment but in reality, they were committing a crime.
Considering the boys used threats to conduct the act this shows a greater chance of having less moral value and one can consider removing them from society. But before this, they should be given a chance to change. Removing them from society without understanding the cause of their actions may not be of greater help. The boys should be enrolled in any community treatment program this will help determine the cause and also if they finish without any new crimes the case can be closed. Their parents should also be involved in order to help support their child and guide them giving them a chance to change. If the boys undergo proper treatment and receive good guidance and care from the family the chances of becoming repeat offenders are minimal. This is because these programs educate them on the risks involved and also give them a purpose for life thus they will strive to be a better them than repeat the offense (Finkelhor, 2009).

Children generally like getting and being the center of attention they try, act, and find ways for getting attention. The girl may have lied in order to receive the attention of either the parents or even the boys. Children often do not know the magnitude of the sexual assault case hence she may have lied due to anger. Anger towards the boys may have caused her to accuse them. Since they are pre-teens and get affected by little things she may have lied as a way of getting revenge on the boys for an offense they did. Maybe not playing with her or sharing their toys or even allowing her to be in their group. Wanting to gain a sense of approval from either her friends, parents or even classmates may have led her to lie so as to fit in due to their sympathy. She could also have lied due to a misunderstanding involved. In this case, she may have vocalized what she maybe saw on the television and an adult misunderstood and urges her to vocalize it. This may lead to her fabricating the story (Newman, 2017).
The accusation causes both emotional damages to the boys and their family too. Considering she is a pre-teen she should not be punished legally but should be educated and informed on the magnitude of such allegations. She also can’t be held legally accountable because it’s the state’s duty to determine whether the allegations are true or not. Many states have laws that hold parents responsible for their children’s crimes. These parents have the responsibility to train their children about right and wrong. They should also discipline them and guide them in making the right decision.
